Endurance Beta terms & conditions

By accessing our beta software "Endurance", you agree to maintain strict confidentiality of all proprietary information and use it solely for evaluation purposes.

1. Purpose and Scope

You are being granted access to a beta version of Loadbalancer.org's product, Endurance, for evaluation and feedback purposes only. This access is subject to strict confidentiality requirements outlined below.

2. Confidential Information

"Confidential Information" includes any non-public, proprietary information you receive, including:
  • Beta software and related documentation
  • Technical specifications and system architecture
  • Product features, designs, and source code
  • Performance data and testing materials
  • Business plans and pricing information

3. Your Obligations

You agree to:
  • Maintain strict confidentiality of all information received
  • Use information solely for evaluation purposes
  • Not disclose any confidential information to third parties
  • Limit access to authorized personnel bound by similar obligations
  • Implement reasonable security measures to protect information

4. Beta Use Restrictions

You may NOT:
  • Use the software in production environments or for commercial purposes
  • Reverse-engineer, decompile, or attempt to derive source code
  • Perform or publish benchmarking without written consent
  • Share software or materials with unauthorized parties

5. Feedback and Ownership

Any feedback, suggestions, or ideas you provide will be considered non-confidential. Loadbalancer.org may use this feedback without restriction or compensation.

6. Data Protection

Both parties will comply with applicable data protection laws including UK GDPR and EU GDPR. You must implement appropriate security measures for any personal data and not process it beyond the stated purpose without written consent.

7. Term and Survival

This agreement continues until terminated by either party with 30 days’ notice. Your confidentiality obligations survive for 3 years after termination. Upon termination, you must return or destroy all confidential materials.

8. No Warranties

The beta software is provided "as-is" without warranties of any kind. Nothing in this agreement grants you any license rights beyond evaluation purposes.
